PE7013 - Real Estate Law and Asset Management

What will I learn on this module?

There will be a series of papers delivered on the following key legal topics. This will complement your learning from Law and Professional Practice and is fundamentally important in learning the relationship between the legal principles of land and property and how the interrelate with being a surveyor:

• Marketing of residential and commercial property and heads of terms.
• Laws affecting the work of surveyors, in particular professional negligence and regulations affecting the sale of land.
• The process of the sale of land.
• Commercial Property leases including key landlord and tenant obligations.
• Landlord and Tenant Law, including the Landlord and Tenant Act 1954.
• Methods of adding value to real estate including re-gearing leases, rent reviews and tenant mix strategy.
• Leasehold exit strategies, including; surrender, break clauses, assignment and sub-letting.
• Asset Management

Throughout this module you will develop academic and professional skills relating to the appraisal of complex real estate markets and the effective management of property portfolios. You will develop skills of appraisal, effective communication and how to advise clients/stakeholders in accordance with RICS governance

How will I learn on this module?

The module is delivered entirely online via our electronic learning platform (elp). You will interact with a range of materials on the module site. The module home page provides you with quick access to detailed information about the module in an interactive, easily accessible format. The teaching materials support your learning. Sessions will deliver flexible, interactive learning materials, accessible in a variety of formats. Tasks to extend and test your learning are interspersed within the learning materials. A range of different tasks, with formative feedback, are aimed at supporting your learning style. In addition to this you will be encouraged to utilise peer to peer support opportunities through the use of elp supported platforms for interaction or, if you choose to, external student supported platforms. Each session is supported by reading accessed through the electronic reading list.

How will I be supported academically on this module?

You will be an autonomous, self-motivated learner within a supportive distance learning environment. You will be introduced to the module by the module tutor in an introductory video. The online module sessions and interactive tasks form the cornerstone for supporting you during your study. Academic support is available from the teaching team and each session includes a link to enable you to email a question directly to the tutor from within the session. Focused academic support coupled with timely formative and summative feedback should enable you to meet your full academic potential within this module.

What will I be expected to read on this module?

All modules at Northumbria include a range of reading materials that students are expected to engage with. Online reading lists (provided after enrolment) give you access to your reading material for your modules. The Library works in partnership with your module tutors to ensure you have access to the material that you need.

What will I be expected to achieve?

Knowledge & Understanding:
• MLO1: Critically analyse and apply the principles of land law, tort, contract and landlord and tenant law.

• MLO2: Critically examine legal problems relating to property ownership and occupation and propose solutions derived from the application of legal principles.

• MLO3: Interpret leases and documentation relating to the sale of land.

• MLO4: Evaluate ways of adding value to real estate by active management strategies and marketing with the use of problem solving, communication.

How will I be assessed?

Feedback for the formative assessments will be given on the ELP in response to the exercises undertaken. For the summative assessments students will receive individual written feedback and general feedback to the cohort. The feedback will identify where marks have been gained and lost and will include recommendations as to how to improve their knowledge and skills.

The module will be assessed by one assessments.



The assessment will allow students to develop their core knowledge in order to assist a client in a variety of property asset management and landlord and tenant issues. This assessment is designed to assess students’ ability to interpret and apply legal rules to derive solutions as well as their written and communication skills. It will require students to interpret lease documentation, research and apply relevant legal principles, develop effective strategies and produce clear advice. The assessment will be worth 100%, be 4,000 words in length and will cover MLO1,MLO 2, MLO 3, MLO 4 and MLO 5.

Module abstract

The management of property as an asset is fundamental to the property professional. This module will enable you to develop a in depth understanding of the proactive management of property, including marketing of real estate, with a view to adding value and minimising risk to the investor. This module will also enable you to develop the legal knowledge required to succeed in real estate practice. The module will enhance your ability to interpret real estate documentation, to problem solve and formulate advice. Consideration will be given to the relationship between the financial aspects of property ownership and occupation. It will include the roles, rights and responsibilities of owners and occupiers of property, landlord and tenant issues, statutory intervention and procedures for acquiring an interest in and disposing of property.

The assessment and learning activities are designed to replicate real world professional practice and includes activities such as reviewing auction packs and leases. The papers and online materials will provide many opportunities for formative feedback through engagement with peers and tutors. The summative assessments are designed to rigorously assess your knowledge of law and practice and your ability to problem solve and effectively communicate ideas. There is an emphasis on research informed learning through the analysis and problem solving of key legal issues. There will be a series of formative and summative assessments to actively promote assessment and feedback. The use of legal research databases will be encouraged to support Technology Enhanced Learning
